In the course of our practice, we have played a leading role in significant cases, both at the state and federal levels.

The most famous of the title insurance cases we have successfully argued remains Palm Beach Sav. & Loan Assn, F.S.A. v. Fishbein , 619 So 2d 267 (Fla. 1993). There, the Florida Supreme Court revised a sixty-year-old doctrine of equitable liens as a rare exception to the otherwise narrowly construed Florida homestead protection and allowed equitable lien against homestead property in favor of the lender where debtor fraudulently obtained loan and used proceeds to satisfy pre-existing mortgages on homestead property.

The Fishbein decision has also been cited throughout the State of Florida by trial and appellate courts. In June of 2001, in Havoco of America, Ltd. v. Hill , 790 So. 2d 1018 (Fla. 2001), the Florida Supreme Court again reiterated its support for the proposition and holdings set forth in Fishbein based upon the arguments attorney Haber cited to that court in 1993.
